Theft by Deception

From:  https://www.pittsburghcriminalattorney.com/theft/theft-by-deception

Here’s how theft by deception works. Theft by deception means that someone uses deception to intentionally obtain or withhold property, including money, that does not belong to them. For example, someone lists a rare BMW on Craigslist at a bargain price and asks everyone who responds to their ad to send them a down-payment to finalize the sale — although the seller does not actually have a BMW to sell.

What is Theft By Deception?

Theft by deception is a type of theft crime when someone intentionally obtains or withholds someone else’s property by deceiving them. In Pennsylvania, someone can be guilty of theft by deception if he or she intentionally does any of the following:
  • Create or reinforce a false impression, including impressions about a law, value, intention
  • or some other state of mind.
  • Keep someone else from acquiring the information that would affect their judgment about a transaction.
  • Fails to correct a false impression that they previously created or or that they know is influencing someone that with whom they have a fiduciary or confidential relationship.

The exception to this is that if you have made false statements about matters that have no financial significance or if you make exaggerated statements that would not deceive ordinary people in the group you are speaking to. This would not be theft by deception.

What is the Penalty for Theft by Deception in Pennsylvania?

Under Pennsylvania law, the seriousness of the grading for theft is based on the value of the property taken.

In most cases, if the property’s value is:
  • More than $2000 — felony of the third degree, punished with up to seven years in prison and a fine up to $15,000
  • $2,000 to $200 — misdemeanor of the first degree, punished with up to five years in prison and a fine up to $10,000
  • $200 to $50 — misdemeanor of the second degree, punished with up to two years in prison and a fine up to $5,000
  • Less than $50 — misdemeanor of the third degree, punished with up to one year in prison and a fine up to $2,500

The emphasis above are my own.  I chose to emphasize these items because I believe they would apply to Umar Johnson and his deception of making/building/creating a school.

Create or Reinforce a False Impression

Umar Johnson traveled all over the country, and indeed, all over the world, deceiving people about an African-centered all-boys school he was going to make/build/create.  He collected money from unsuspecting African-descent people from all over the world, deceiving them about his intentions.

As of today, after at least eight (8) years of this bogus campaign for a school, there has been no documentation, no announcement of a team, no documentation or announcement of a curriculum by grade level, no accreditation application, and no preliminary budget, AND, most importantly, no explanation or documentation of the over $700,000 to $1,000,000 of Black people's donation money.

Of course, he continues to call the money that people give him under these false pretenses "donations" even though he had a 501(c)(4) status for three years -- from approximately 2014 to 2017-- revoked.  The revocation makes the money given no longer, legally speaking, "donations."

By the way, has anyone who donated money to Umar Johnson's invisible school get a receipt?

The non-profit status for Umar Johnson's organization was revoked in 2017, after three years of not completing the required 1099 forms (which would have been public) to show what was being done with the money.

Can't keep calling the money you get donations if your nonprofit status is REVOKED!

Keeping Someone Else from Acquiring Information

Umar Johnson has not shared any documentation.

Why?

Umar Johnson has not shown any accreditation application.

Why?

Umar Johnson has not shown a record of the money collected.

Why?

Umar Johnson has insulted and denigrated anyone who could have helped him achieve the goal of the school.

Why?

Umar Johnson has no team.

Why?

Umar Johnson blocks any and every person from his social media (including yours truly).

Why?

Well, the answers are obvious.  If you have documentation, it's a written record.  If someone would try to help, you, it wouldn't take that person long to figure out that Umar Johnson's invisible school is nothing more than a scam.  If there is a team, anyone on the team with the sense God gave a goose egg would figure out that Umar Johnson was full of it.

Umar Johnson wants his donors to only rely on what he says, which could change from one moment to the next, from one Youtube video to the next, from one ridiculous tweet to the next, from one narcissistic Instagram post to the next.

Besides, relying on only what one person says is cult-like behavior.

The result of all of this is that information is being kept from his donors, his supporters, and the public.

Umar Johnson is a criminal.  He belongs in prison.

  1. I come across so many people (mostly Umarians) that think that I should not care since I didn't give Jermaine any of my money. This is the same logic that Umar spews every time he is questioned about the money. He claims his "supporters" don't care about how long he holds on to the money and only the "haters" are the ones bringing it up. So basically if it's not my money being stolen then I shouldn't give a damn..... however with this logic, I don't see how anyone can take this man seriously about caring for the "poor African boys" .... after all they are not his children. We can see how he interacts with his own.... HE doesn't. The only time he mentions he even has kids is to complain about child support. I will never take my foot off this dusty thief's neck because he belongs in jail. This latest scheme of him pretending to open a door with a FDMG keychain is utterly disgusting down to his filthy nails. He needs to be arrested for trespassing on private property. This man is out of control! What has me in tears with pity and laughter for his brain dead followers, is that they are so naïve to believe a school is opening, when he literally just posted a picture while possibly committing a crime.
