What is a SLAPP Lawsuit?

SLAPP (Strategic Lawsuit Against Public Participation) is a meritless lawsuit filed to intimidate and silence critics who are speaking out on a matter of public interest. 

Purpose

These lawsuits are designed to drain the defendant's financial and emotional resources through expensive legal battles, even if the plaintiff has little chance of winning the case. The primary goal is not to win on the legal merits, but to punish and deter the defendant and others from speaking out in the future. 

Desired Effect

To intimidate and silence critics, such as activists, journalists, or everyday citizens who are voicing opinions on public issues. 

Mechanism

Leveraging the high cost of legal defense to overwhelm the defendant and make them abandon their criticism. 

Who Files SLAPP Lawsuits

Typical filers of SLAPP lawsuits are powerful individuals, corporations, or government bodies who are being criticized. 

Who are Targets of SLAPP Lawsuits

Typical targets of SLAPP lawsuits are people or organizations who are critical of those in power or involved in public advocacy on topics like environmental protection, civil rights, or consumer protection. 

Intended Impact

SLAPP lawsuits can have a "chilling effect" on free speech by discouraging people from participating in public debate for fear of a costly and time-consuming lawsuit. 

Countermeasures

Many states and jurisdictions have passed anti-SLAPP laws to protect defendants facing such lawsuits.

The Dunning-Kruger Effect

The Dunning-Kruger effect is a cognitive bias in which people with limited competence in a particular domain overestimate their abilities.  It was first described by the psychologists David Dunning and Just Kruger in 1999.
