Opening An Abandoned Building

When someone opens an abandoned building and claims it's a school without a Certificate of Occupancy(CO) in Wilmington, Delaware, the consequences stack fast and hard. 

What the Law Says (plain English)

An abandoned building cannot be legally occupied, let alone used as a school.
No CO = the building is legally unsafe and unapproved for human use, especially children.
Calling it a "school" does not change that.  It actually makes it worse.


Immediate Consequences


1. Forced shutdown

  • The City of Wilmington Licenses  & Inspection can issue an immediate stop-use or vacate order
  • The Delaware State Fire Marshal can shut it down on sight if there are fire or life-safety hazars
  • Police assistance may be used to enforce the closure

No warnings are required if people are at risk.


2. Fines & Daily Penalties

  • Fines can be issued per day of illegal occupancy
  • Additional penalties can be issued for:
  • Unsagfe structure
  • Illegal change of use
  • Occupying a condemned or abandoned property

These fines add up quickly.


Criminal Exposure (Yes, Criminal)


3. Child Endangerment


If minors are inside, authorities can pursue child endangerment or reckless endangerment charges especially likely if there are hazards like:
  • Mold
  • Exposed wiring
  • No fire exits
  • No heat, water, or sanitation
This is no longer "paperwork trouble."  This is criminal law.

4. Fraud & Deception


If the operator:
  • Advertises it as a school
  • Accepts tuition or donations
  • Claims non-profit or educational status
They may face investigation for misrepresentation or fraud, especially if parents were misled.

Civil Liability (The Lawsuits)


Parents or staff can sue for:
  • Negligence
  • Unsafe premises
  • Emotiona distress
  • Injury and/or illness
  • Misrepresentation
No CO means no insurance coverage.  So, the cost of damages often come out of pocket.


Property & Ownership Consequences


The city may:
  • Condemn the building
  • Board it up
  • Fine the owner (even if they "allowed" someone else ot use it)
If the operator doesn't own the building:
  • Trespassing charges are possible
  • The landlord can also be penalized

Nonprofit or School Status Fallout


If they claim non-proit or school status:
  • State approval can be denied or revoked
  • IRS non-profit status can jeopardized
  • Further appliocations will be flagged
Once this happens, everything is scrutinized.

The Big Takeaway


Opening an abandoned building as a "school" without a CO in Wilminton is not a loophole--it's a multi-layered violation that include:
  • Illegal occupancy
  • Life-safety violoations
  • Child endangerment risk
  • Fraud exposure
  • Civil and criminal liability

My Notes and Opinions

I suggest that reading the above more than once.  The first time, read it as is.  The second reading, substitute in your mind the word "school" with the words "religious institution" to see if it make sense to you.  Lastly, read it again and substitute the word "school" with the words "community center" to see if it adds up to you.

I'm not a lawyer.  However, I think it's the same applicaton of the law.  What about you?

As of today, the properties we call FDMG in Wilmington, DE are still on the vacant property list.

Will Umar Johnson still allow people to come in and use the buildings as a "school," "religious institution," or "community meeting" place?  He may, although it will be illegal to do so, if there is no certificate of occupany (and therefore no insurance can be placed on those builidngs) and they remain on the vacant property list.

The Umar Johnson scourge, at this point, is not a problem that can only be resolved on social media.  I seriously wonder what the community there in Wilmington, DE know or are doing about these buildings, especially the mayor, City Council and other elected officials on the local and state level.  In my opinion, it will take the citizens of that community as well as the people of the larger Wilmington, DE community, since they have boots on the ground and will be most immediatly impacted by the physical state of those abandoned buildings.

Because, regardless of anything, we know Umar Johnson has to be stopped.
